The Town Of Merryville will be holding a public meeting on December 14, 2009 at 5:30 pm at Merryville Town Hall located at 530 Hennigan Street in Merryville, Louisiana. ORDINANCE NO 1101 STATE OF LOUISIANA TOWN OF MERRYILLE The following Ordinance was introduced by Councilwoman Carolyn S. Rhodes who moved for its adoption and was seconded by Councilman David E. Eaves, Jr. AN ORDINANCE DECLARING THAT PORTIONS OF CERTAIN STREETS IN NICHOLS THIRD ADDITION TO THE TOWN OF MERRYVILLE HAVE BEEN ABANDONDED AND ARE NO LONGER NEEDED FOR PUBLIC PURPOSES AUTHORIZING THE REVOCATION OF THE DEDICATION OF SAME PURSUANT TO LOUISIANA REVISED STATUE 48:701, AND FURTHER PROVIDING WITH RESPECT THERETO WHEREAS, the plat of NICHOLS THIRD ADDITION TO THE TOWN OF MERRYVILLE was filled March of 1921, in Plat Cabinet 1, Slide A15, of the records of Beauregard Parish; and WHRERAS, said plat shows the locations of streets in Nichols Third Addition; WHEREAS, various portions of the streets as shown on the plat of Nichols Third Addition were never constructed and/or building and other structures were placed over them. WHEREAS, the indicated portions of the following streets in Nichols Third Addition were never constructed and/or other structures were built over them many years ago, to-wit: North Avenue between Franks Street on the West and Bryan Street on the East: Weaver Street between Franks Street on the West and Bryan Street on the East; and South Avenue between the west line of Block 73 of Nichols Third Addition extended in a southerly direction on the West and Bryan Street on the East. WHEREAS, the above described portions of North Avenue, Weaver Street and South Avenue are not needed for any public purpose and the Town of Merryville deems the revocation of the dedications of the above set out portions of North Avenue, Weaver Street and South Avenue to be in the best interest of the Town of Merryville. THEREFORE, BE IT ORDANIED by the Board of Aldermen of the Town of Merryville that the following described portions of North Avenue, Weaver Street and South Avenue in Nichols Third Addition to the Town of Merryville as shown on plat recorded in March of 1921 in Plat Cabinet 1, Slide A15 of the records of Beauregard Parish are not needed for any public purpose and their dedication is hereby revoked in accordance with Louisiana Statute 48:701: North Avenue between Franks Street on the West and Bryan Street on the East: Weaver Street between Franks Street on the West and Bryan Street on the East; and South Avenue between the west line of Block 73 of Nichols Third Addition extended in a southerly direction on the West and Bryan Street on the East. BE IT FURTHER ORDAINED that under the provisions of Louisiana Revised Statue 33:4712 that prior to the final adoption hereof, notice of this Ordinance shall be published in the official journal three (3) times within fifteen (15) days, one week apart and that any opposition hereto must be made in writing, filed with the Clerk of the Council within fifteen (15) days of the first publication. PROCEEDINGS OF THE COUNCIL OF THE CITY OF DERIDDER, STATE OF LOUISIANA, TAKEN IN REGULAR SESSION HELD ON MONDAY NOVEMBER 9, 2009, 2009 AT 5:30 OCLOCK P.M. The Council of the City of DeRidder, Louisiana met in regular session at its meeting place, the Council Chambers, located in City Hall, 200 S. Jefferson Street, DeRidder, Louisiana on Monday, November 9, 2009 at 5:30 oclock P.M. PRESENT: Elizabeth Granger, Joseph Siciliano, Robert Rice, Gordon Jenkins, Jonnie Mango, Hayward Steele, and President Labue. ABSENT: None ALSO PRESENT: Ron Roberts, Mayor; Jerry DeWitt, Community Services Director; David R. Lestage, City Attorney; Allen Shellenbarger, Director of Public Works; and Penny R. Simmons, Clerk of the Council. President Labue called the meeting to order, called upon Councilman Steele to deliver the invocation and Mr. Jorge Quinones, Freedom Team Salute Ambassador, a representative of the U. S. Army, to lead the Pledge of Allegiance. VISITOR'S DOCKET Mr. Sonny Jackson contractor Mr. Jackson addressed the council stating that he was seeking clarification on the matter of bids being presented to the city for work connected to properties that have been condemned. He was to turn in a bid on this date and found out that the work had been done just prior to the bid letting and felt that there should be some time frames established. Since he makes his living doing jobs like these, it cuts him out of the process at the last minute. He would like the city to set some rules down for said procedures. Mayor Roberts stated they would take the matter under advisement to research for a solution. AMENDMENTS TO THE AGENDA Councilman Jenkins made a motion to amend the agenda regarding Item 11(D), the ordinance needs to be done as two single items, making them Agenda Items 11 (D & E), and Councilman Siciliano offered a second. The motion was unanimously approved. Councilman Jenkins made a motion to amend the agenda to include two resolutions, making them Agenda Items 10 (B&C), and Councilman Rice offered a second. The motion was unanimously approved. ADOPT THE MINUTES FROM THE REGULAR MEETING OF OCTOBER 26, 2009 AS PUBLISHED IN THE OFFICIAL JOURNAL. Councilman Rice made a motion to adopt the minutes from the regular meeting of October 26, 2009 as published in the official journal and Councilman Siciliano offered a second. The motion was unanimously approved. PRESENTATION A) Jorge Quinones / Freedom Team Salute Ambassador / U.S. Army Mr. Quinones addressed the council stating that he thanked all those who supported the military as well as those who have served in the military. He went on to present commendations to present Mayor Roberts, Jerry DeWitt, Community Relations Director, Kerri Broussard, mayors assistant, and Vincent Labue, City Council President and thanked them for supporting the Army and its mission. He went on to present commendations to James Fritze and ohn Davison with Chief Gott accepting the awards for several other officers who were unable to attend the meeting. CONDEMNATIONS A) Jonnie Bennett 615 E. North St.(tabled 10.26.09) The DPW stated that Mr. Bennett is prepared to make the necessary renovations to the property and is in line for a building permit and advised the council to let this matter remain on the table. B) Lillie Morris 601 W. W. Batties St.(tabled 10.26.09) Mr. Morris stated that he would like to repair the structure and was advised to meet with the DPW this week to work out a plan and time frame for said repairs. The matter will remain on the table. C) Angela Roberson Shady Lane (tabled 10.26.09) The DPW stated that there has been no communication from the property owner and stated that it should be condemned. Councilman Siciliano made a motion to remove the matter from the table to allow council action, Councilman Rice offered a second and the motion was unanimously approved. Councilman Jenkins made a motion to condemn said property allowing the property owner 30 days to clean/clear the property of structure and debris and Councilman Siciliano offered a second. The motion was unanimously approved. D) Janice Dixon Elm St. (tabled 10.26.09) There has been no communication from Ms. Dixon, therefore, the consensus was to leave the matter on the table at this time. ACCEPT / DENY RECOMMENDATIONS FROM THE DeRidder PLANNING & ZONING OMMISSION / REGULAR MEETING OF MONDAY- 11.2.09 A) Request from Jeffery Holmes for special exception use / Class B m.h. / R-3 Zone / 318 E. 3rd St. Councilman Rice made a motion to accept the recommendations of the DeRidder Planning and Zoning Commission, allowing time for notices to be sent to the surrounding property owners and Councilman Steele offered a second. The motion was unanimously approved. President Labue set the public hearing for this matter for Monday, November 23, 2009 at 5:30 p.m. Mr. Lestage was called upon to read aloud and in full the following resolutions (B&C) before the council for consideration of adoption after holding a public hearing on each of them respectively, to-wit: B) A RESOLUTION ADDRESSING ADMINISTRATIVE ASPECTS OF THE PROPOSED Y 2010 - FY 2011 LOUISIANA COMMUNITY DEVELOPMENT BLOCK GRANT PROJECT WHEREAS, the City of DeRidder is desirous of submitting an application to the State of Louisiana, Division of Administration for funding under the FY 2010 FY 2011 LCDBG program for streets; and WHEREAS, it is necessary to pay all administrative costs associated with the implementation of the LCDBG program to receive one bonus point, should funding become available. NOW, THEREFORE, BE IT RESOLVED that the City of DeRidder has hired the administrative and engineering firms of GNF Management Company, Inc. and Meyer & Associates, Inc. to assist in the preparation of said application for the fees of $1,400.00 and $1,500.00, respectively. An additional fee of $35,000.00 will be paid to the administrative firm of GNF Management Company, Inc. for subsequent program administration of the LCDBG program. All fees are contingent upon funding of the project by the State of Louisiana, Division of Administration under the FY 2010 or the FY 2011 LCDBG program. BE IT FURTHER RESOLVED that the City of DeRidder has agreed to utilize local funds to pay the above contract amount and all other administrative costs associated with the preparation and implementation of the FY 2010 FY 2011 LCDBG program. BE IT FURTHER RESOLVED and known that a motion was made by Councilman Siciliano and a second was offered by Councilwoman Granger to adopt this resolution as presented with the vote to approve adoption being unanimous. The DPW requested the council table this matter in order to allow the property owner time to work out a problem with the installation of sewer service. Councilman Siciliano made a motion to table the ordinance and Councilwoman Mango offered a second. Public Hearing ORDINANCE NO. 1684 CHARTER SERIES AN ORDINANCE AMENDING THE CODE OF ORDINANCES FOR THE CITY OF DERIDDER UNDER CHAPTER 7.5-MOBILE HOMES AND CHAPTER 15 ZONING TO ADD STANDARDS FOR DETERMINATION OF CLASS B MOBILE HOMES; AND REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH. WHEREAS, the City of DeRidder does maintain the zoning ordinance for the use and protection of all property located within the corporate limits of the City of DeRidder; and WHEREAS, the updates of the zoning laws and requirements shall be reflected in the Code of Ordinances of the City of DeRidder; and WHEREAS, under Chapter 7.5-Mobile Homes found on page 448 in the Code of Ordinance book, the following requirements shall be added as 7.5-32.(2)a.- Definitions, to-wit: Standards for determinations of Class B status: (2)a. A Class B mobile home shall have a minimum width, as measured across the narrowest portion of the dwellings main structure, of not less than fourteen (14) feet. WHEREAS, under Chapter 15-Zoning Article 15-61.Supplementary Use Regulations, found on page 1174 of the Code of Ordinance book, it shall be amended to include the following information under (5)a.-Class B Mobile Home Determination requirements, to-wit: (5) Class B Mobile Home Determination: A Class B mobile home shall have a minimum width, as measured across the narrowest portion of the dwellings main structure, of not less than fourteen (14) feet. Exterior finish materials of the Class B mobile home shall not reflect light of greater intensity than would be reflected from a surface painted with clean white, gloss enamel. Vinyl siding or equivalent is preferable. Obscure from view any wheels, undercarriages, framing extensions, etc. All mobile homes shall be skirted with similar material in appearance to the mobile home exterior surface. NOW, THEREFORE, BE IT ORDAINED that the City Council of the City of DeRidder does hereby approve and adopt the amendments stated in the body of this ordinance and declares that it shall be inserted into the Code of Ordinance book as herein presented. BE IT FURTHER ORDAINED that all ordinances or parts of ordinances in conflict herewith, be and the same, are hereby repealed. They did a great job and the crowd was much bigger than expected. On Tuesday, November 10, 2009 at 5:30 p.m. there will be a Town Hall meeting at the War Memorial Civic Center regarding the DeRidder Development Ready Community Program and asked the council members to attend. Saturday, November 14, 2009 is the Culinary Festival with 12 cooks participating. We are looking forward to a large crowd this year and again invited the council to come and participate. B) Director of Public Works Mr. Shellenbarger addressed the council stating that the parking lot is completed at the new eastside park and the lights have been installed around the walking trail. The 2009 Street Overlay Project is nearly completed. KCS is in town for the purpose of installing new crossings in the Washington Avenue area. Washington Avenue will be closed for a period of time while these installations are being made. It will be a slight inconvenience, but the crossings will be nice and smooth when completed. C) City Council Councilwoman Granger stated that there are approximately 100 citizens involved in the Development Ready City Program and their participation is greatly appreciated. She also provided each council member with a folder of pictures of different spray parks, each different in design, price and color. She will discuss more on this matter at a later date. Councilman Rice requested that 440 feet of sidewalk be installed on North Street to complete that portion that was already done. Mr. Shellenbarger stated that that would be done in the near future. Councilwoman Mango stated that Lewis Street has a sharp curve in it and that the sign was overgrown and hard to see. She asked the DPW to have that portion of the road cleaned up to make the sign more visual. Also, Muldrow Street is badly overgrown and unkempt and asked the DPW to see about having that area cleaned up as well. ADJOURN There being no further business to come before the council, Councilman Rice made a motion to adjourn the meeting and Councilman Siciliano offered a second.
